Terms of Service

1. Introduction

Welcome to Knitlingo ("Knitlingo," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our knitting pattern marketplace and AI language translator services (collectively, the "Service") accessible through knitlingo.com and any associated applications.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service. These Terms constitute a legally binding agreement between you and Knitlingo.

Our Privacy Policy, accessible at https://www.knitlingo.com/en/privacy-policy, is incorporated by reference into these Terms and explains how we collect, use, and protect information from our users.

2. Account Terms

2.1 Eligibility

You must be at least 18 years old to use the Service. You must provide accurate, current, and complete account information.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to your account. We reserve the right to disable any account for security reasons or violation of these Terms.

3. Marketplace Terms

3.1 Seller Responsibilities

Sellers are responsible for the accuracy and legality of the knitting patterns they upload. Sellers retain ownership of the knitting patterns they upload. Sellers are responsible for handling any disputes with buyers.

3.2 Buyer Responsibilities

Buyers are granted a personal, non-exclusive, non-transferable license to use purchased knitting patterns. Buyers may not modify, distribute, or resell purchased knitting patterns.

3.3 Fees and Payments

Sellers will receive payment for sales after a 3% flat fee is automatically deducted by Knitlingo, in addition to the payment platform's (Stripe's) processing fees. Payments are processed through Stripe. You must provide accurate and complete billing information. You authorize us to charge your chosen payment method. All payment information is subject to Stripe's terms and privacy policy.

3.4 Refunds

Refunds for knitting pattern purchases are at the sole discretion of the seller. Each seller may establish their own refund policy, which should be disclosed to buyers. Knitlingo does not facilitate refunds but may provide mediation upon request.

4. Translator Terms

4.1 Service Description

Knitlingo provides an AI-powered language translation service for knitting patterns and related text.

4.2 Usage Rights and Responsibilities

Users must ensure they have the right to translate any content they upload, whether by owning the copyright, obtaining a license, or receiving explicit permission from the original author. Knitlingo assumes no responsibility for copyright infringement or legal disputes arising from unauthorized translations.

4.3 Fees and Payments

The AI language translator service is priced based on the word count of the original document. Payments are processed through Stripe. You must provide accurate and complete billing information. You authorize us to charge your chosen payment method. All payment information is subject to Stripe's terms and privacy policy.

4.4 Satisfaction Guarantee

Knitlingo offers a 100% satisfaction guarantee for the AI translation service. If you are not satisfied with the quality of the translation, please contact us for a full refund.

5. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates applicable national or international law or regulation.
  • To infringe on the intellectual property rights of others.
  • To upload or transmit any material that is defamatory, harassing, abusive, incites violence, promotes hate speech, or otherwise violates applicable laws and community standards.
  • For any purpose that violates the rights of others.

Additionally, you agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair it.
  • Use any robot, spider, or other automatic device, process, or means to access the Service.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other malicious material.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Service.
  • Reverse-engineer, decompile, or replicate our platform, AI algorithms, or proprietary content without explicit written permission.

6. Intellectual Property

Knitlingo retains all rights to the platform, technology, and AI systems. This includes software, algorithms, text, graphics, logos, and interface design. No transfer of intellectual property rights is implied by your use of the Service.

7. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. KNITLINGO SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Knitlingo provides AI-generated translations "as is" and makes no warranties regarding their accuracy, completeness, or suitability for a particular purpose. Users acknowledge that translations may contain errors, and Knitlingo is not liable for any financial loss, business disruption, or reputational harm resulting from reliance on AI-generated outputs.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amounts paid for the Service. We are not liable for any damages resulting from: Service interruptions or delays; AI system performance or outputs; Actions taken based on AI outputs; Loss or unauthorized access to data; Third-party provider actions.

8. Term and Termination

These Terms remain in effect until terminated by either party. We reserve the right to terminate or suspend access to the Service immediately for any violation of these Terms, security risks, or legal reasons. In other cases, we will provide reasonable notice where possible. If your account is terminated, you may contact us to request clarification.

9. General Provisions

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the Service constitutes acceptance of modified Terms. These Terms constitute the entire agreement between you and Knitlingo.

9.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall be enforced to the fullest extent permitted by law.
